By purchasing or operating equipment supplied by Garden Machinery Direct, you acknowledge that outdoor power equipment must be selected, assembled, operated, transported, stored, and maintained according to the applicable manufacturer instructions and safety requirements.

Nothing in these terms is intended to exclude or limit rights that cannot lawfully be excluded under applicable consumer-protection law.

Applicable written warranties

Products are supplied subject to the written warranty, product description, manufacturer documentation, and other terms expressly provided with the order or published by Garden Machinery Direct.

Except for warranties expressly stated in writing and any rights that apply by law, products are provided without additional representations or implied warranties, including implied warranties of fitness for a particular purpose, merchantability, or non-infringement, to the extent such limitations are legally permitted.

Confirm suitability before operating equipment

Customers are responsible for reviewing the product specifications and determining whether the selected equipment is suitable for the intended property, terrain, workload, operator, power source, and operating environment.

• Confirm the recommended lawn size, gradient limits, cutting capacity, and terrain requirements.
• Check the equipment’s dimensions, weight, access requirements, and storage needs.
• Verify fuel, battery, charging, electrical, oil, and maintenance requirements before use.
• Do not operate equipment for a purpose outside the manufacturer’s stated applications.

Use equipment correctly and responsibly

All equipment must be operated in accordance with the official operator manual, safety labels, manufacturer instructions, and applicable safety requirements.

Qualified installation and maintenance

Assembly, installation, adjustment, repair, and servicing must follow the applicable manufacturer procedures. Work requiring specialist mechanical, electrical, fuel-system, battery, blade, or safety-system knowledge should be completed by a suitably qualified person.

Before carrying out maintenance, switch off the equipment, remove the ignition key where applicable, disconnect the spark-plug lead or battery as directed, and allow moving or hot components to stop and cool.

Failure to follow installation or servicing instructions may create a safety risk, damage the equipment, and affect warranty eligibility.

Unauthorized alterations may void coverage

Unauthorized modification, tampering, performance tuning, bypassing safety devices, or alteration of equipment may void applicable warranty protection and create serious operating risks.

• Do not remove, disable, or bypass guards, interlocks, shutoff systems, or warning devices.
• Do not make unauthorized structural, mechanical, electrical, fuel-system, battery, or software changes.
• Do not increase operating speed, power output, blade speed, load capacity, or towing capacity beyond approved limits.
• Do not install attachments or components that have not been verified as suitable for the specific model.

Garden Machinery Direct is not responsible for injury, malfunction, property damage, or equipment failure caused by unauthorized modifications or tampering.

Attachments, accessories, and replacement parts

Compatibility must be confirmed before fitting any third-party attachment, accessory, battery, charger, blade, belt, cutting head, replacement part, towing accessory, or other component.

A component fitting physically does not necessarily mean it is safe or approved for use. Customers must verify model compatibility, weight limits, power requirements, mounting specifications, control-system requirements, and manufacturer approval.

Garden Machinery Direct is not responsible for damage, malfunction, reduced performance, or injury resulting from an incompatible, incorrectly installed, uncertified, or unsuitable third-party product.

Keep equipment properly maintained

The owner and operator are responsible for completing routine inspections and maintenance according to the schedule and procedures stated in the manufacturer documentation.

Conditions generally excluded from coverage

Warranty coverage is governed by the written terms applicable to the specific product. Unless those written terms state otherwise, coverage generally does not include:

• Normal wear items such as blades, belts, filters, seals, fluids, cutting lines, chains, tires, and similar consumable components
• Damage caused by misuse, overloading, collision, neglect, improper operation, or insufficient maintenance
• Failures caused by incorrect fuel, contaminated fuel or oil, unsuitable lubricants, or improper charging
• Damage caused by unauthorized repairs, alterations, tuning, or incompatible parts and attachments
• Improper storage, corrosion, rust, flooding, lightning, weather exposure, or other environmental damage
• Cosmetic wear or deterioration that does not prevent normal operation

Use equipment in accordance with applicable requirements

The purchaser and operator are responsible for complying with applicable federal, state, and local requirements governing equipment operation, transport, noise, emissions, fuel storage, battery handling, workplace safety, and use in public or regulated areas.

Garden Machinery Direct is not responsible for penalties, losses, or damage caused by unlawful operation, transportation, storage, modification, or disposal of equipment.

Prevent foreseeable injury and damage

Outdoor power equipment can cause serious injury or property damage when used incorrectly. The owner is responsible for preventing access by children, untrained operators, and anyone unable to use the equipment safely.

• Never operate equipment while impaired, distracted, or physically unable to maintain control.
• Do not allow passengers unless the equipment is expressly designed and approved for them.
• Do not leave running equipment unattended.
• Keep hands, feet, clothing, and tools away from blades and moving components.
• Follow all shutdown, transport, refueling, charging, and storage procedures.

Limits that apply where legally permitted

To the maximum extent permitted by applicable law, Garden Machinery Direct will not be liable under contract, warranty, negligence, strict liability, or another legal theory for indirect, incidental, special, consequential, exemplary, or punitive losses arising from product use, misuse, installation, maintenance, storage, modification, or incompatibility.

Such losses may include:

• Loss of profit, revenue, business opportunity, or productivity
• Business interruption or operational downtime
• Loss of data or records
• Consequential property, landscaping, or environmental losses
• Additional rental, labor, transport, recovery, or replacement costs

Where legally permitted, the total liability of Garden Machinery Direct relating to a product will not exceed the amount paid for the product giving rise to the claim. This limitation does not apply where liability cannot lawfully be excluded or limited.

Claims arising from prohibited conduct

To the extent permitted by law, the purchaser agrees to indemnify and hold harmless Garden Machinery Direct and its personnel from third-party claims, losses, liabilities, and reasonable expenses arising from the purchaser’s unlawful use, unauthorized modification, negligent operation, violation of safety instructions, or infringement of another party’s rights.
